Will of Nathan Stanly ~ 1852
I Nathan Stanly of the County of Jones and State of North Carolina, being
of sound mind and memory, but considering the uncertainty of my earthly
existence do make and declare this my last will and testament in manner and
form following, that is to say:
First- That my executor (hereinafter named) shall provide for my body a
decent burial suitable to the wishes of my relations and friends and pay
all funeral expenses together with my just debts howsoever and to whomsoever
owing out of the moneys that may first come into his hands as a part and
parcel of my estate.
Item 1st- I loan to my beloved wife Ann E. during the time of her widowhood
all my interest in my real estate undivided between myself and Brother
Benjamin F. Stanly. I also loan to my wife all my Negroes for her support
and the support and education of my children, Mary Ann, Susan Amanda,
Winneford Caroline, and Nathan. In case my wife or Brother Benjamin F.
should desire a division in my real estate between myself and him, they can
do so by having a committee appointed to divide the lands between us. If my
wife or either of my children should marry or become of age then to have
their portion both real and personal property allotted and set off to each
or either of them.
Item 2nd- I loan to my wife all my household and kitchen furniture, farming
utensils of every description, buggy, stock of every kind, and a plentiful
support for the family and stock for the present year also the money and
notes I have in hand to be used for the support and benefit of my wife and
children.
And lastly I do hereby constitute and appoint my Brother Benjamin F. Stanly
my lawful executor to all intents and purposes to execute this my last will
and testament according to the true intent and meaning of the same and
every part and clause thereof, hereby revoking and declaring utterly void
all other wills and testaments by me hereunto made.
In witness whereof I the said Nathan Stanly do hereunto set my hand and
seal this 21st day of January A. D. 1852.
